The Minority in Parliament has accused President John Mahama of breaching Section 4(1) of the Presidential Office Act by announcing appointments to his office without consulting the Council of State.
The Minority contends that the President made the appointments on January 21, 2025, despite the Council of State not yet being constituted.
The Minority further argues that the President did not clarify that these appointments were provisional, pending the formation of the Council of State, as required by law.
Speaking on behalf of the Minority, the Member of Parliament for Okaikwei Central, Patrick Boamah, urged the President to retract the appointment letters and adhere to the legal requirements of the Act.
“Section 4(1) says that the president shall appoint such officers in consultation with the Council of State. We, as a Minority, believe that the President has acted in breach of this Act or the provisions of Act 463.”
“We are requesting the President to kindly withdraw this letter and act in consultation with the Council of State, which is not in place. At best, this letter could have been issued with a paragraph stating that these appointments are being made pending the composition of the Council of State and will be regularized in conformity with this Act,” Boamah stated.
