President Akufo-Addo Addresses Petition Against Chief Justice, Emphasizes Importance of Evidence and Judicial Independence

President Nana Addo Dankwa Akufo-Addo has thoughtfully reviewed a petition seeking the removal of Chief Justice Gertrude Sackey Torkornoo, ultimately concluding that it lacked sufficient merit for further investigation. The petition, filed by Professor Stephen Kwaku Asare, raised concerns about alleged misconduct and competence, including issues related to panel reconstitution, issuance of practice directions, and potential breaches of constitutional obligations.

Upon consultation with the Council of State, the President highlighted several key factors in his decision:

Lack of Supporting Evidence: The allegations presented were not backed by credible documentation or factual support.

Consistency with Legal Standards: The actions taken by Chief Justice Torkornoo, particularly in relation to her administrative duties under the Courts Act, demonstrated a commitment to established legal practices.

Further, the President expressed concern regarding the premature public dissemination of the petition, which he deemed a violation of Article 146(8) of Ghana’s Constitution. This Article emphasizes the need for confidentiality in such proceedings, underscoring the importance of upholding the integrity and solemnity of the judicial process.

The Council of State’s review concluded that the petition lacked legal standing, describing it as “frivolous, vexatious, and unmeritorious.” In light of these findings, the President made the decision to dismiss the petition, reaffirming his dedication to maintaining the integrity of the judiciary.

In his statement, President Akufo-Addo articulated a strong defense of judicial independence, emphasizing that it is fundamental to Ghana’s democratic framework. He cautioned against unsubstantiated claims that could hinder public confidence in the judicial system.

This incident serves as a reminder of the delicate balance between ensuring transparency and accountability in governance while protecting judicial independence.
